In New York, the penalties for speeding can vary widely depending on factors such as how far over the limit you were traveling and the location of the violation. New York has been a leader in regulating the use of mobile devices behind the wheel. In fact, it was the first state to prohibit handheld cell phone use while driving, passing legislation in 2001 as mobile phones were becoming more common. What began as a relatively minor offense with modest penalties has become far more serious over time. As smartphones have become more advanced and distractions more numerous, the law has evolved accordingly, and enforcement has grown stricter.

Reckless Driving

Many traffic violations are treated as infractions that typically result in fines, surcharges, and points on a driver’s record, which can also lead to higher insurance costs. Reckless driving, however, is treated very differently under New York law. When a driver is accused of operating a vehicle in a way that shows a disregard for the safety of others, the charge rises to the level of a misdemeanor criminal offense. Courts take these allegations seriously, and a conviction can carry significant penalties beyond those associated with ordinary traffic tickets.

Driving Without a License

Anyone who operates a motor vehicle in New York is required to hold a valid driver’s license. Getting behind the wheel without one can lead to substantial legal consequences. If a person knew, or reasonably should have known, that their driving privileges were suspended or revoked, they may be charged with aggravated unlicensed operation, which is considered a serious offense. Even in situations where a driver was unaware of an issue with their license, the matter can still result in a citation and court appearance, although the penalties may be less severe.

How Many Points Will I Get For My NY Traffic Violation?

The New York DMV’s point system is as follows:

  • Speeding 1–20 mph over the speed limit: 4 points
  • Speeding 21–30 mph over the speed limit: 6 points
  • Speeding 31–40 mph over the speed limit: 8 points
  • Speeding more than 40 mph over the speed limit: 11 points
  • Reckless driving: 8 points
  • Failure to stop for a school bus: 8 points
  • Following too closely (tailgating): 4 points
  • Inadequate brakes on a private vehicle: 4 points
  • Inadequate brakes on an employer’s vehicle: 2 points
  • Failure to yield the right of way: 5 points
  • Failure to move over for stopped emergency or authorized vehicles: 3 points
  • Disobeying a traffic light, stop sign, or yield sign: 3 points
  • Railroad crossing violation: 8 points
  • Improper passing or unsafe lane change: 4 points
  • Driving left of center or in the wrong direction: 3 points
  • Leaving the scene of an incident involving property damage: 3 points
  • Child safety restraint violation: 4 points
  • Improper cell phone use: 6 points
  • Texting while driving: 6 points
  • Other moving violations: 2 points

You should also note that, under VTL 1180-f, a conviction for speeding in a work zone will result in a mandatory 8 points, regardless of speed.

It is important to note that, as of February 13, 2026, the New York DMV is overhauling its system and penalties, resulting in significant changes to the point system and license suspension period. As such, beginning mid-February, drivers who accumulate 10 points on their license within a 24-month period will face a license suspension, down from 11 points in 18 months. You should note, however, that this is separate from the Driver Responsibility Assessment fee, which is still imposed when a driver accumulates 6 or more points on their license within 18 months.
