Methamphetamine is ta synthetic dangerous substance.  In New York, it is considered a Schedule II(d) controlled substance.  Use, distribution, and manufacturing methamphetamines is illegal in New York.  Anyone who is charged with a methamphetamine drug crime can be subject to harsh penalties.

What are the Categories of Methamphetamine Offenses?

There are four main categories of methamphetamine offenses:

  • Possession and control of a controlled substance;
  • Sale of a controlled substance;
  • Having drug paraphernalia; and
  • Manufacturing methamphetamine.

What are the possible penalties for a methamphetamine charge?

The penalties, if you are charged with a methamphetamine drug crime, differ based on the class of the charge.  The penalties may include:

  • Class A Misdemeanor.  If you are convicted of a Class A misdemeanor can be sentenced up to 1 year in jail and a fine up to $1,000.00.
  • Class E Felony.  If you are convicted of a Class E felony, the penalties can be a maximum of 4 years in prison and a fine up to $5,000.00.
  • Class D Felony.   If you are convicted of a Class D felony, the penalties can be a maximum of 7 years in prison and a fine up to $5,000.00.
  • Class C Felony.  If you are convicted of a Class C felony, the penalties can be a maximum of 15 years in prison and a fine up to $15,000.00.
  • Class B Felony.  If you are convicted of a Class E felony, the penalties can be a maximum of 25 years in prison and a fine up to $30,000.00.
  • Class A-II Felony.  If you are convicted of a Class A-II felony, the penalties can life in prison and a fine up to $50,000.00.
  • Class A-I Felony.  If you are convicted of a Class A-I felony, the penalties can be life in prison and a fine up to $100,000.00.
