If you are charged with larceny, you must understand the consequences you may face. Most convictions come with the potential of imprisonment. The penalties for various theft crimes are as follows:

Petit larceny

• Property valued at $1,000 or less
• Class A misdemeanor
• Fines not to exceed $1,000
• Up to 364 days in prison

Grand larceny in the fourth degree

• Property value is more than $1,000 but less than $3,000
• Class E felony
• Fines not to exceed $5,000 or double the offender’s gain from the crime
• Potential for up to 4 years in prison
• Certain situations can elevate the charge regardless of value, like credit or debit cards, firearms, and extortion

Grand larceny in the third degree

• Property valued at more than $3,000 but less than $50,000
• Class D felony
• Potential for up to 7 years in prison

Grand larceny in the second degree

• Property value is more than $50,000 but less than $1 million
• Class C felony
• Up to 15 years in prison

• Property value is more than $1 million

• Up to 25 years in prison

Updates to New York’s larceny laws

New York law has changed over the past few years to expand the scope and enforcement of larceny laws to include:

• Employers can now be charged with grand larceny for wage theft, as NY PL § 155.05 now includes compensation for labor and services under the definition of property
• NY PL §155.30 now allows prosecutors to aggregate, or combine, the value of goods shoplifted from different stores as part of a “common scheme”
• Repeat offenders
