When you are pulled over for suspicion of drunk driving, you may be asked to submit to a number of tests. It is important to remember that test refusal will result in automatic drivers' license revocation - regardless of DWI conviction. In addition to the officer's observations during field sobriety tests, chemical testing will likely be used to calculate your Blood Alcohol Content (BAC) and prove intoxication.

Breathalyzer Tests: Officers commonly request individuals to submit to a breath test as one of the field sobriety tests. However, the breath test may also be administered at the police station. This test is an indirect test for determining the actual concentration of alcohol in one's blood. Therefore, test results may not be entirely accurate. It is possible that a machine malfunctioned or was defective. Additionally, other factors may have influenced the reading levels.

Blood Tests and Urine Tests: If an officer suspects that an individual is also under the influence of illegal drugs, the officer may request that the individual submit to a blood test or alcohol test in order to determine existence of illegal drug substance in addition to alcohol content levels.

Suppression of Intoxication Evidence

The US constitution gives each citizen rights. If these rights are violated in collecting evidence against you, the evidence may be suppressed from the record and from the courtroom -- weakening the prosecutor's case against you. We have comprehensive understanding of DWI laws and know how to zealously protect our clients' rights.

We investigate all aspects of the traffic stop, arrest, and interrogation, searching for violations of your rights. For example, if there was not reasonable or probable cause for the traffic stop or the arrest, any evidence obtained after that fact may be withheld from the court.

Additionally, we analyze breathalyzer equipment and other equipment to verify if there were defects influencing the result. We often obtain independent testing to prove our client's innocence.
